Manages prime contract activities to ensure that all requirements and obligations are fulfilled, including any coordination with key Supply Chain (Major Subcontracts) as required. Tasks include coordinating and submitting proposals, and leading negotiations. Together with the Project Management Team, proactively anticipates, identifies, analyzes and informs management of the financial, legal and performance risks that can impact success. Ensures Cubic continues to manage its contractual obligations (internal and external) and keep management informed regarding performance under assigned Contracts and proposals. This position typically exercises discretionary and substantial decision-making authority under limited supervision and direction.

Essential Job Duties and Responsibilities:

  • Conducts and leads contract formation - including any coordination with key Supply Chain (Major Subcontracts) and Program Management - and contract management/administration activities on varied contract types with U.S. government and non-government customers, as well as foreign and commercial customers. Such contracts consist of systems, hardware, software, and related development, installation and support, from initial solicitation, customer-compliant proposal submission and negotiations, through performance end and including closeout.
  • Primary point of contact for prime contract and project personnel and responsible for all incoming and outgoing contract correspondence with the customer.
  • Coordinates with Contracts staff, key Supply Chain (Major subcontracts), Data Management and Program Management to monitor the status of all contract deliverables for compliance with contract requirements.
  • Exercise independent judgment in identifying risks in solicitation requirements, proposals and contracts, raising risks to Program Management, Contracts and Business Unit (as appropriate) leadership; and make recommendations for mitigating such risks.
  • Resolves issues regarding contractual performance, including claims, changes, and terminations.
  • Leads the submission and negotiation of contract proposals, including change orders. Coordinates with Contracts leadership, Business Development, Program Management, Engineering, Business Unit leadership, and Cost Estimating personnel on proposal preparation and submittal. Negotiates with customers, working directly with a team of cognizant functional department personnel in conducting the negotiations to assure the resulting contract best supports Company business objectives.
  • Responsible for project Change Management and coordination of contractual activities; collaborates with Project Manager and Supply Chain (Major Subcontracts) to develop effective strategies and recommendations to management for resolution of contractual issues in a timely manner.
  • Interacts with, confers, briefs, and makes recommendations to senior Contracts and Business Unit leadership regarding the progress and impact of potential contract and subcontract-related activities on the project. Prepares contracting action reviews, identifies and reports on any issues or concerns.
  • Drafts contractual agreements; edits terms and conditions and flow-down requirements to key Supply Chain (Major Subcontracts) based on prime contracts consistent with company Legal and Contract policies.
  • Coordinates with Supply Chain (Major Subcontracts) and Program Management in support of key project related subcontracts to ensure compliance with terms, including schedule and scope of work.
  • Coordinates closely with Supply Chain (Major Subcontracts) and Program Management in support of the resolution of any subcontractor performance issues, including claims, changes, and terminations.
  • Coordinates contract requirements with all functional departments to ensure compliance.
  • Ensures that Contracts databases are updated and maintained in an accurate and timely manner, including the maintenance and retention of documentation covering the complete contractual record and evidence of review and approvals obtained in accordance with the Company's prescribed approval matrix and any delegations of authority.
  • Mentors less-experienced Contracts Professionals, as well as personnel in Program Management, Engineering, Business Development, Quality Assurance and key Supply Chain (including Major Subcontracts), in Contracting law, regulation and process.
  • Performs other related duties and assignments as directed by senior Contracts leadership.
  • Observes all legal/ regulatory compliance requirements and practices for assigned areas of responsibility, including assigned responsibilities under any direct-report personnel.
  • Remains current on legal/regulatory updates affecting contracts and agreements.

Minimum Job Requirements:

  • Four-year college degree, preferably in a technical or business-related discipline.
  • Eight (8)+ years of progressive experience in contracts management and personnel development.
  • Demonstrated leadership ability in Contract Management for various types of contracts such as fixed price development, cost-type, service agreements, system, hardware and software installation and maintenance agreements, etc., for U.S. government and non-government customers, as well as foreign and commercial customers, ranging in size from $1M to in excess of $50M.
  • Requires a strong working knowledge of Federal Acquisitions Regulations (FAR), Defense FAR Supplements (DFARS) and International Traffic and Arms Regulations (ITARs).
  • Thorough knowledge of prime contract formation and administration/management activities, and proven ability to effectively negotiate terms, conditions and price.
  • Ability to provide workable solutions to address a wide variety of contractual challenges.
  • Must be able to prioritize assignments and meet deadlines with minimal supervision, including the coordination with and oversight of any direct reports.
  • Possess analytical skills necessary in order to organize, plan, execute and administer/manage contracts and agreements with various customers.
  • Possess interpersonal skills necessary to function in a team environment, and interact in extremely delicate, sensitive and/or complex situations dealing with U.S. and foreign agencies and commercial customers.
  • Proficient in the use of PC and associated business software, as well as familiarity and experience with SAP.
  • Ability to travel occasionally if required.

Cubic Pay Range:

$125,000 - $173,455.15 + benefits.

The Cubic pay range for this job level is a general guideline only and not a guarantee of compensation or salary. Additional factors considered in extending an offer include (but are not limited to) responsibilities of the job, education, experience, knowledge, skills, and abilities, as well as internal equity, alignment with market data, applicable bargaining agreement (if any), or other law.
