Job Summary

At Salt Lake Community College, we believe our people make us great. Within our People & Workplace Culture team, this position in collaboration with the Director, Benefits and HRIS and the Benefits team, will work closely with employees and supervisors regarding FML, ADA, Leaves and Long-Term Disability.

Under minimal supervision, utilize professional judgement to determine outcomes for complex high risk and high liability FMLA/ADA employee case outcomes. Collaborate with legal counsel and state risk on complex high risk and high liability FMLA/ADA cases. Consult with and advise supervisors and employees on cases specifically involving ADA and FMLA.

This position will navigate complex ADA and medical leave situations while considering both the human element and the framework and standards of operation within the law. Draft and coordinate FMLA, Employee ADA, and other leave policies and guidance for the College. Monitor compliance and employment law changes on a regular basis and updates practices and policy accordingly.

Essential Responsibilities and Duties

Family Medical Leave and Leave Management:
  • Under minimal supervision, utilize professional judgement to determine outcomes for complex high risk and high liability FMLA employee case outcomes. Collaborate with legal counsel and state risk on complex high risk and high liability FMLA cases.
  • Meet with employees and or supervisors to explain the requirements and benefits of family leave.
  • Receive and review FMLA requests; obtain completed request forms, physician certification or re-certification forms, and return to work releases.
  • Determine employee qualification status and approve or deny request; correspond with employees and supervisors and maintain contact throughout the process; serve as the point of contact for all FMLA questions; reviews complex requests with the Director, Benefits and HRIS.
  • Prepare notifications of approval/denial. Follow up with department and payroll to ensure the time is recorded correctly.
  • Prepare and maintain spreadsheets/software to track the status of FMLA requests and approvals and denials.
  • Ensure highly confidential files are maintained in accordance with Federal record keeping. regulations including, Health Insurance Portability and Accountability Act (HIPAA) and Family Leave Act (FMLA) regulations.
  • Research statistical information to prepare reports throughout the year.
  • Advise employees, once their FMLA leave is exhausted, about additional sick leave options and Long Term Disability (LTD) processes; maintain communication with appropriate parties until sick leave or Long Term Disability is approved or disapproved; prepare related paperwork.
  • Complete initial paperwork for the LTD company.
  • Follow up with the department and payroll to ensure the necessary paperwork is processed.
  • Review medical documentation of employees returning from a leave of absence and, when appropriate, coordinate accommodations for those with restrictions.
  • Evaluate and update FMLA process in line with DOL, State and Federal laws, and best practices.
  • Manage emergency pay and leave process.
  • Coordinate ADA, FML, and leave, considerations for response to college emergency/outbreaks.
  • Provide annual status of leaves and accommodations to AVP as requested.
  • Serve on committees with respect to mitigating risk regarding leaves and accommodations.
ADA:
  • Determine outcomes for complex high risk and high potential liability ADA employee case outcomes. Collaborate with legal counsel and state risk on complex high risk and high liability ADA cases.
  • Meet with employees and or supervisors to explain the requirements and benefits of ADA accommodations and start the interactive process, serve as the point of contact for all ADA questions; reviews complex requests with the Director, Benefits and HRIS.
  • Request and review documentation received from employee and/or physician.
  • Review job description, meet with supervisor to determine essential functions.
  • Make determination of reasonable accommodation
  • Consult with State Risk Management on all denials and other issues as appropriate.
  • Prepare notifications of approval/denial.
  • Purchase accommodation items and work with supervisor and employee to implement approved accommodations.
  • Prepare and maintain spreadsheets/software to track purchased and issued ADA items/software.
  • Ensure highly confidential files are maintained in accordance with Federal record keeping regulations including, Health Insurance Portability and Accountability Act (HIPAA) and Americans with Disabilities (ADA) regulations.
  • Evaluate and update ADA process in line with DOL, State and Federal Laws, and best practices.
  • Follow up with employee/supervisor as appropriate.
Leaves:
  • Meet with employees and or supervisors to explain the requirements and benefits of Leaves offered by the college, ie., Military Leave, Jury Duty, Bereavement, Vacation, Staff Development, etc.
  • Follow up with the department and payroll to ensure the necessary paperwork is processed.
  • Provide recommendations to Director regarding policies and procedures concerning employee leaves.
Sick Leave Pool:
  • Meet with employees and or supervisors to explain the requirements and benefits of Sick Leave Pool.
  • Determine employee qualification status and approve or deny the request; correspond with employees and supervisors and maintain contact throughout the process; serves as the point of contact for all sick leave pool questions; reviews complex requests with the Director, Benefits and HRIS.
  • Prepare notifications of approval/denial. Follow up with department and payroll to ensure the time is recorded correctly.
  • Maintain information in a confidential medical file.
  • Coordinate with Director, Benefits and HRIS and Benefits team as needed.
FML/ADA Training and Compliance:
  • Develop and deliver FML and ADA training to supervisors, staff, faculty, administration.
  • Create new opportunities and materials for understanding FML/ADA.
  • Coordinate with Department on workplace posters requirements.
  • Draft and coordinates FML and Employee ADA policies and guidance for the College.
  • Monitor compliance and employment law changes on a regular basis and updates FML/ADA practices and policy accordingly.
  • Communicate with and updates respective departments and leadership on any changes to FMLA/ADA law changes.
Nursing Mother Resource Coordination:
  • Assist Nursing Mother’s with their questions and resource needs.
  • Provide training to departments.
  • Coordinate available resources with Facilities.
  • Maintain robust resources web page.
Other duties as assigned.

Minimum Qualifications

  • Bachelor’s degree in Human Resources or related field.
  • Four (4) to six (6) years of full-time experience in human resources.

Trade off 2:1 in experience/education requirement.
Part time experience may be substituted on a prorated basis.

Preferred Qualifications

Master’s degree in Human Resources or related field.
Employee Benefit experience.
FML and ADA experience.
HR Certification.

Knowledge, Skills & Abilities

  • Knowledge of Federal and State HR statutes, laws, and regulations.
  • In-depth knowledge of Family Leave (FMLA), Americans with Disabilities Act (ADA), and other employee leaves, with ability to appropriately apply standards and problem solving skills to reduce liability to the College.
  • Knowledge of Human Resource Information Systems (HRIS).
  • Knowledge of word processing, spread sheet, presentation, and report writing software.
  • Business English, writing and vocabulary, business math.
  • Ability to write effectively and concisely.
  • Effective communication and human relations skills.
  • Demonstrate advanced level of judgement, critical thinking skills, and discretion dealing with highly sensitive and confidential information.
  • Demonstrate effective listening and empathic skills to understand the best ADA and leave outcome for employees and for the College.
  • Ability to create and maintain a good working relationship with College departments, and internal staff.
  • Ability to create understanding when working with individuals and groups as it pertains to leaves.
  • Demonstrate high level of professional judgement to make decisions regarding complex high risk and high liability FMLA/ADA employee case outcomes.
  • Ability to be self-directed, prioritize and align work with desired outcomes of the College.
  • Ability to complete complex assignments that impact outcomes with minimal supervision.
  • Ability to navigate complex interpersonal and medical leave situations while considering both the human element and the framework and standards of operation within the law.
